Supreme Court Upholds 'Bail as the Rule' Principle in Money Laundering Case

The Supreme Court of India, on August 28, granted bail to Prem Prakash, an alleged associate of former Jharkhand Chief Minister Hemant Soren, in a case related to illegal mining.

The court emphasized that even in cases under the Prevention of Money Laundering Act (PMLA), the principle that
"bail is the rule and jail is the exception" still applies.
The bench, comprising Justices BR Gavai and KV Viswanathan, reaffirmed that the deprivation of liberty should not be the norm.
The court referenced its August 9 decision involving AAP leader Manish Sisodia, reiterating that individual liberty is the rule, and its deprivation should occur only through the due process of law.

The Supreme Court overturned a previous Jharkhand High Court order that had denied bail to Prakash and directed the lower court to expedite the trial.
