Texas has scheduled the execution of Robert Roberson for October 17, despite new evidence suggesting he was wrongfully convicted for a crime that never occurred.

Roberson's conviction is based on the now-debunked shaken baby syndrome (SBS) hypothesis, which claimed that his daughter Nikki’s death was due to violent shaking.

However, new medical evidence reveals that Nikki died from severe pneumonia and septic shock, not from abuse.

Experts and advocates, including former prosecution witnesses, are urging for a review of the case, emphasizing that Roberson may be innocent of the crime for which he is being punished.

His legal team, joined by the Innocence Project, is fighting to stop the execution and highlight the flaws in the original trial, which included inaccurate medical testimony and failure to consider Nikki’s complex medical history.

With time running out, they call for intervention from Texas Governor Greg Abbott to prevent a wrongful execution.

Latest update as of 9:00 PM.

Just one day before his planned execution, Robert Roberson, a death row inmate, was subpoenaed by a Texas House committee that is re-examining the legality of his conviction. He was convicted of murdering his 2-year-old daughter in 2002, a crime which advocates argue did not happen.

“Nikki died of consequences of pneumonia— cardiac arrest — and she was basically brain-dead in a living body,”

Auer said Dr. Roland Auer, a Canadian neurosurgeon who has testified in similar cases, said Nikki was not the victim of abuse.

The committee hearing is scheduled for October 21, but it remains unclear whether Roberson’s execution, set for Thursday, will be delayed.

The Texas Department of Criminal Justice is consulting with the attorney general’s office to determine the next steps.
