India's New Trade Secrets Law: Closing a Major IP Gap

India is taking a significant step to close a major gap in its intellectual property framework by actively considering a dedicated trade secrets law. Currently, the protection of confidential business information such as formulas, processes, and strategies relies on a patchwork of common law principles, contractual agreements like NDAs, and scattered provisions in the Indian Contract Act and the Information Technology Act.


This fragmented approach often leads to legal uncertainty and enforcement challenges for businesses.

The proposed shift, driven by the Law Commission's recent report, would establish a clear statutory framework, defining what constitutes a trade secret and providing specific legal remedies for misappropriation.


This move would bring India in line with global IP standards, offer businesses more robust and predictable protection for their most valuable undisclosed information, and provide a crucial tool for fostering innovation.
