Teacher giving Flowers to Minor Students would amount to POCSO action

In a recent ruling, the Supreme Court of India has determined that the action of a male school teacher presenting flowers to a minor girl student and pressuring her to accept them in front of others in a classroom constitutes sexual harassment under the Protection of Children from Sexual Offences (POCSO) Act. However, the court also emphasized the need for careful examination of the evidence, considering the potential impact on the teacher's reputation.
The bench comprising Justices Dipankar Datta, K V Vishwanathan, and Sandeep Mehta highlighted discrepancies in the evidence provided by the allegedly harassed minor student and witnesses. Consequently, the court overturned the previous rulings of a Tamil Nadu trial court and the Madras High Court, which had sentenced the teacher to three years of imprisonment.
