Several state governments have declined to comply with the orders issued by the National Commission for Protection of Child Rights (NCPCR) to survey madrasas, citing concerns over potential violations of institutional and fundamental rights.
This refusal has sparked debate over whether the government's actions are impeding efforts to ensure children's rights and welfare in these religious schools.
The Commission says that madrassa education is violative of Articles 29 and 30 of the Indian Constitution, as well as the Right to Education (RTE) Act 2009.
The Commission has also asked Unified District Information System for Education Plus (UDISE) .
