Police Appeal to Higher Court to Try Accused Minor as Adult

The decision by the Juvenile Justice Board in Pune to grant bail to a teenager involved in a fatal car accident, while requiring him to write an essay on road safety, has sparked controversy.


A day after the board's ruling, the police announced on Monday their intention to seek permission from a higher court to prosecute the minor as an adult.


The incident, which occurred in Kalyaninagar, involved a Porsche without a registration number hitting a two-wheeler, resulting in the deaths of Anis Awadhiya (24) and Ashwini Costa (24), both engineers from Madhya Pradesh.

Newly surfaced CCTV footage shows the 17-year-old drinking with friends at a pub hours before the accident. The footage, reportedly from Cosie Bar, displays the teen's table laden with alcohol bottles.


Pune Police Commissioner Amitesh Kumar stated that they had initially requested the court to try the juvenile as an adult and place him in an observation home, but their plea was denied. They now plan to make the same appeal to the sessions court.


Preliminary investigations indicate the teen was intoxicated at the time of the accident, although his blood report is still pending. Commissioner Kumar confirmed that the CCTV footage shows the juvenile consuming alcohol, reinforcing their case.



Additionally, the police have filed charges against the teen's father under the Juvenile Justice Act and against the bar owners for serving alcohol to a minor. The investigation of these related cases has been transferred to the crime branch.


We have approached the sessions court to replace section 304-A (causing death by rash and negligent driving) with the more stringent section 304 (culpable homicide) of IPC," said Pune police commissioner Amitesh Kumar.

Bail Conditions:


The accused is required to write a 300-word essay on the topic "Effects of Road Accidents and Their Solutions." Additionally, the parents must ensure that he does not commit the same offense again and keep him away from negative influences.


The accused must also study the traffic rules and submit a report within 15 days.


Mandatory counseling sessions have been ordered for the accused, and the parents are responsible for ensuring his attendance before the Juvenile Justice Board.
