"Karnataka High Court Grants Bail to Rape Accused for Marriage to Survivor"

The Karnataka High Court has granted a 23-year-old man, accused of raping a minor, a 15-day bail to marry the survivor, who recently turned 18 and has given birth to his child. Both families support the marriage, and DNA tests have confirmed the man as the child's biological father.


The court's decision aims to protect the interests of the child and assist the young mother.


The accused must provide a marriage certificate by the next court hearing on July 4 and return to custody by the evening of July 3. Justice M Nagaprasanna issued this interim order, responding to the petitioner's request to dismiss charges since both families favor the marriage.


The man, from Mysuru district, was arrested in February 2023 on allegations of repeatedly sexually assaulting the girl when she was 16 years and nine months old.


He faces charges under Section 376(2)(n) of the IPC and Sections 5(L), 5(j)(ii), and 6 of the POCSO Act, 2012. Justice Nagaprasanna emphasized the importance of marriage to support the mother and child in their vulnerable situation.
