Recently Central Government clarified that all the traini level officers at entry level of the examination should be unmarried for the post of judge advocate generals and once the complete their trainings or get commission they can marry.
The reason the reason being stated by them
Was the mental and physical level of requirement during the training of a candidate.
The Centre on Wednesday defended before the Delhi High Court the policy barring married individuals from applying for Judge Advocate General (JAG), the legal officer in the army, and said considering the "effects of marriage", the bar is a "reasonable restriction placed in public interest and the interest of national security".
the condition of being unmarried for grant of commission to cadets aged 21-27 years is "restricted only for the period of recruitment and pre-commissioned training" which involves a high amount of stress and rigours of military training and the restriction on marriage before successful commission is in the interest of the candidates as well as organisation
The Centre, in its earlier affidavit filed in March 2019, said that right to marry cannot be a right to life under the Constitution and there was no discrimination on the basis of marital status of the candidates.
"Once unmarried lady cadets and gentlemen cadets complete their training and are granted commission, there is no bar for getting married or its natural consequences of pregnancy etc and service benefits viz. maternity leave, child care leave, paternity leave or married accommodation etc. During conduct of Basic Military Training, which lasts for minimum one year, such provisions are not possible,"
The government further said that since pregnancy and giving birth to a child is considered as natural right for a women and she cannot be deprived of that, "such precautionary conditions" have been laid down in the interest of women candidates themselves.
"We have said only for training. Because the training is physical and mental and for the 11 months period of training, will not allow either married men or women. There is no gender bias. It is at par with the entire Army and is followed in all sections," the ASG(Additional solicitor general) had said
Overall looking forward with the statement been given by central government it is more clear that they concern is about well being of candidates itself.
This matter has been for the postponed till next hearing in the July.
