Impersonation: The Case of Fake IFS Officer Jyoti Mishra

In response to social media trolling due to mistaken identity, 2021 batch Indian Foreign Service officer Jyoti Mishra clarified she is not the Jyoti Mishra accused of changing caste to SC for IAS selection.
The IFS officer, currently on probation as a third secretary at the Indian embassy in Madrid, emphasized she ranked 432 in the second list of UPSC 2021 as a general candidate, unlike the IAS Jyoti Mishra ranked 432 in the first list, who hails from Mahendragarh, Haryana.
Jyoti Mishra from Rae Bareli, Uttar Pradesh, asserted her commitment to fair practices and hard work and announced plans to take legal action against those harming her reputation.

Section 319 BNS (1) A person is said to “cheat by personation” if he cheats by pretending to be some other person, or by knowingly substituting one person for or another, or representing that he or any other person is a person other than he or such other person really is.
Explanation. —The offence is committed whether the individual personated is a real or imaginary person.
THE EMBLEMS AND NAMES (PREVENTION OF IMPROPER USE) ACT, 1950:
Section 3. Prohibition of improper use of certain emblems and names.
Notwithstanding anything contained in any law for the time being in force, no person shall, except in such cases and under such conditions as may be prescribed by the Central Government, use or continue to use, for the purpose of any
trade, business, calling or profession, or in the title of any patent, or in any trade mark or design, any name or emblem specified in the Schedule or any colourable imitation thereof without the previous permission of the Central Government or such officer of Government as may be authorised in this behalf
by the Central Government.
