"HIV-Positive Pilot Challenges DGCA's Discriminatory Restrictions in Bombay High Court"

An HIV-positive trainee pilot from India has filed a case in the Bombay High Court against the Directorate General of Civil Aviation (DGCA) for not allowing him to serve as a pilot-in-command due to his HIV status.


Although the US Federal Aviation Administration (FAA) has deemed him fit to fly, the DGCA restricts him to co-pilot roles, which limits his employment opportunities in India.


Represented by advocate Bhoomika Vyas, the pilot argues that this decision infringes on his fundamental rights and violates both international aviation standards and Indian anti-discrimination laws.


The petition seeks to overturn the DGCA's decision and demands a fitness assessment based solely on his physical health, without bias related to his HIV status.
