The Punjab and Haryana high court emphasized that merely breaching a contract or agreement, without a dishonest intention from the outset, does not warrant criminal proceedings.


Justice Harpreet Singh Brar, in response to a plea filed by Charanjit Sharma and another, stated that criminal actions should only arise if there is evidence of dishonest intent from the beginning. The court highlighted the increasing misuse of criminal law for civil disputes, urging against converting civil matters into criminal offenses for expeditious resolutions.


The HC quashed an FIR against the petitioners, noting the dispute's civil nature and issuing instructions to prevent unwarranted criminal prosecution, stressing that the trial court should assess the case's civil or criminal nature and act accordingly.
